Terms of Service

These Terms govern your use of Serversium's hosting and related services. By signing up or using our services, you agree to be bound by these Terms.

1. Acceptance of Terms

By creating an account, ordering any service, or otherwise using Serversium's products, you agree to be bound by these Terms of Service, our Privacy Policy, Acceptable Use Policy, and any other policies referenced herein. If you do not agree, do not use our services.

2. Service Description

Serversium provides hosting infrastructure including but not limited to: virtual private servers (VPS/VDS), dedicated servers, web hosting, email hosting, game server hosting, domain registration, SSL certificates, DDoS protection, VPN, proxy, monitoring, and data-center colocation services. Specific terms for each service are detailed in the relevant order form.

3. Account Responsibilities

You are responsible for maintaining the confidentiality of your account credentials, all activity that occurs under your account, ensuring billing information is accurate, and complying with all applicable laws while using our services.

4. Payment Terms

Services are billed in advance based on the cycle selected at order (monthly, quarterly, semi-annual, annual). Payment is due upon receipt of invoice. Failure to pay within 7 days of due date may result in service suspension. Service termination may occur after 30 days of non-payment. Refunds are available within 7 days of initial purchase for most services (30 days for web hosting).

5. Acceptable Use

You may not use our services for illegal activities, copyright infringement, spam, phishing, malware distribution, child exploitation material, harassment, or any activity that violates applicable laws. See our Acceptable Use Policy for full details. Violations may result in immediate service termination without refund.

6. Service Level Agreement (SLA)

We target 99.99% network and power uptime. SLA credits are issued for downtime exceeding our commitment, calculated as a percentage of monthly fees. SLA credits must be requested within 30 days of incident. See our SLA document for full details.

7. Data and Privacy

We handle customer data per our Privacy Policy and applicable data protection laws (including GDPR and KVKK). You retain ownership of all data you store on our infrastructure. We do not access customer data except as necessary for support (with your authorization), security incident response, or legal compliance.

8. Limitation of Liability

Serversium's total liability for any claim arising out of or relating to these Terms or our services shall not exceed the total fees paid by you in the preceding 12 months. We are not liable for indirect, incidental, consequential, or punitive damages, including lost profits or data loss.

9. Indemnification

You agree to indemnify Serversium against any claims, damages, or expenses arising from your use of our services, violation of these Terms, or infringement of third-party rights.

10. Termination

You may terminate your account at any time from your client area. We may terminate or suspend your account for material breach of these Terms, non-payment, or violation of our Acceptable Use Policy. Upon termination, your data may be deleted after 30 days unless backup retention has been arranged.

11. Governing Law

These Terms are governed by the laws of the Republic of Turkey. Any disputes shall be resolved in the courts of Izmir, Turkey, unless otherwise required by mandatory consumer protection laws.

12. Changes to Terms

We may update these Terms from time to time. Material changes will be notified via email at least 30 days before taking effect. Continued use of our services after the effective date constitutes acceptance of the updated Terms.
